The Karnataka Authority for Advance Ruling (AAR) delivered a comprehensive ruling on the GST implications for various charges collected by a Resident Welfare Association (RWA), specifically addressing water and electricity recoveries, corpus fund contributions, and community centre maintenance charges. The applicant, an apartment owners’ association, sought clarity on whether these collections attract GST and, if so, under what conditions and at what point in time.
Water Charges Recovery
Addressing the first issue, the AAR examined whether the recovery of water charges from members, even when billed separately, is liable to GST. The Authority noted that while water as a good is generally exempt under Entry No. 99 of Notification No. 02/2017-Central Tax (Rate), the recovery by the RWA is not a standalone supply of water. Instead, it forms an integral part of the overall maintenance services provided by the association to its members. The AAR clarified that such recoveries are taxable as part of the composite supply of maintenance services, and GST is applicable if the total monthly contribution per member, including water charges, exceeds the exemption threshold specified under Entry 77 of Notification No. 12/2017-Central Tax (Rate).
Electricity Charges Recovery
On the second issue, the AAR considered whether electricity charges recovered for common areas on an actual cost basis are exempt from GST. The applicant argued for exemption under Serial No. 104 of Notification No. 02/2017-Central Tax (Rate) and claimed to act as a ‘pure agent’ under Rule 33 of the CGST Rules. The AAR, however, found that the electricity bill is issued in the name of the association and is consumed as an input for providing maintenance services. The association does not act as a pure agent for its members in this context. Therefore, the recovery of electricity charges is also considered part of the maintenance services and is subject to GST, again subject to the exemption threshold under Notification No. 12/2017.
Corpus Fund Collections
Regarding the collection of corpus funds for future capital expenditure, the AAR analyzed whether such collections constitute a ‘supply’ under Section 7 of the CGST Act, 2017. The Authority distinguished corpus contributions from capital investments in business entities, emphasizing that corpus contributions are non-refundable and do not confer ownership or profit rights. The AAR held that these collections are advances for future supply of services and thus qualify as consideration for a taxable supply. Consequently, GST is payable at the time of receipt of the corpus fund, as per Section 13(2)(a) of the CGST Act, which defines the time of supply as the date of receipt of advance amounts.
Community Centre Maintenance Charges
The AAR also addressed whether monthly charges for the upkeep of the community centre could be classified as maintenance charges eligible for exemption. The Authority found that the community centre is an integral part of the residential complex, providing recreational and common facilities exclusively to members. Such charges are considered part of the overall maintenance services and are eligible for the exemption threshold of Rs. 7,500 per member per month under Clause (c) of Sl. No. 77 to Notification No. 12/2017-Central Tax (Rate), provided the total maintenance charges do not exceed this limit.
Conclusion and Ruling
The Karnataka AAR concluded that all such recoveries—water, electricity, corpus fund, and community centre maintenance—are part of the composite supply of maintenance services by the RWA to its members. GST is applicable on these charges if the total monthly contribution per member exceeds the prescribed exemption threshold. Corpus fund collections are treated as advances for future supply and are taxable at the time of collection. The ruling provides much-needed clarity for RWAs and their members regarding the scope and timing of GST liability on various types of collections.
