Background:
The proceedings before the Goods and Services Tax Appellate Tribunal (GSTAT) Principal Bench arose from a letter by the Director General of Anti-Profiteering (DGAP), seeking directions on whether a fresh investigation should be initiated against SJP Hotels & Resorts Pvt. Ltd. based on a complaint by a homebuyer, Shri Navnit Kumar, regarding the “Migsun Wynn” project. The DGAP noted that two earlier complaints concerning the same project and period had already been investigated, resulting in a detailed report and a final order by the erstwhile National Anti-Profiteering Authority (NAA), which found the Respondent liable for profiteering under Section 171 of the CGST Act, 2017.
Prior Proceedings and Finality:
The NAA’s order, dated 26.07.2022, was challenged by the Respondent before the Delhi High Court, which dismissed the writ petition, thereby affirming the NAA’s findings. The DGAP’s investigation had already quantified the profiteered amount, including the sum attributable to the present Complainant. The Tribunal noted that the issue of profiteering for the relevant period (01.07.2017 to 31.12.2019) had thus attained finality in both fact and law.
Withdrawal and Settlement:
During the proceedings, the Complainant communicated his unconditional withdrawal of the complaint, citing receipt of possession of his flat. The Respondent submitted that all disputes had been settled through a Settlement Deed, and all financial transactions, including any anti-profiteering amounts, had been resolved.
Tribunal’s Reasoning:
The Tribunal framed the core issue as whether a fresh investigation could be initiated on the same subject matter already adjudicated. It held that the principles of res judicata preclude reopening matters that have been fully and finally decided by a competent authority and affirmed by a superior court. Allowing a fresh investigation on the same cause of action, for the same project and period, would undermine legal certainty and constitute an abuse of process.
Order and Legal Principle:
The GSTAT Principal Bench concluded that no fresh investigation was warranted, as the matter had already been investigated, adjudicated, and affirmed by the High Court. The Tribunal expressly held that the doctrine of res judicata applies to anti-profiteering proceedings, barring multiple or parallel proceedings on the same subject matter. The present proceedings were declared not maintainable and were accordingly dropped, with directions that the DGAP take no further action on the withdrawn complaint.
Conclusion:
This decision reinforces the finality of adjudicated anti-profiteering matters and clarifies that once a matter has been conclusively decided, including affirmation by a superior court, it cannot be reopened through fresh complaints for the same cause of action, project, and period. The order was pronounced in open court on 26 May 2026.
