Background and Context
The applicant, AGS Health Pvt. Ltd., operates in the Information Technology Enabled Services (ITES) sector and provides Business Process Outsourcing (BPO) services to clients outside India. Due to the nature of its business, the company operates in multiple shifts, with office hours often extending beyond 8:00 PM. Under the Tamil Nadu Shops and Establishments Act, 1947, and relevant government notifications, it is mandatory for employers to provide transportation facilities and ensure the safety of women employees working in shifts.
The applicant sought an advance ruling on the eligibility of input tax credit (ITC) for GST paid on services of leasing, renting, or hiring motor vehicles used to provide such transportation. Specifically, the applicant asked whether ITC could be availed for these services, whether it could be claimed for all shifts, and from what date such ITC would be available.
Legal Framework and Submissions
The applicant referenced Section 17(5)(b) of the CGST Act, 2017, which generally blocks ITC on leasing, renting, or hiring of motor vehicles, except where it is obligatory for an employer to provide such services under any law. The applicant argued that, following the insertion of a proviso effective from 01.02.2019, ITC should be available when such transport is a statutory requirement. The applicant also cited relevant circulars and previous advance rulings supporting their position.
During the personal hearing, the applicant confirmed that no cost is recovered from employees for the transportation facility and undertook not to claim ITC for transport provided exclusively to male employees.
Court’s Analysis and Reasoning
The Authority examined the statutory provisions and the specific notifications under the Tamil Nadu Shops and Establishments Act, which require employers to provide transport for women employees working between 8:00 PM and 6:00 AM. The AAR noted that the CBIC Circular No. 172/04/2022 clarified that the proviso to Section 17(5)(b) applies to the entire clause, making ITC available where the employer is legally obligated to provide such services.
The AAR held that ITC on leasing, renting, or hiring of motor vehicles for employee transport is generally blocked, but the statutory obligation to provide transport for women employees working night shifts creates an exception. The Authority further clarified that ITC is only available for transport provided to women employees during the mandated hours (8:00 PM to 6:00 AM), not for all shifts or for transport provided exclusively to male employees.
Regarding the period of eligibility, the AAR determined that ITC is available from 28.05.2019, the date when the relevant government notification made such transport obligatory. However, the availment of ITC is subject to the conditions and time limits prescribed under Section 16 of the CGST Act, 2017. The Authority rejected the applicant’s argument that ITC should be allowed for prior periods or beyond statutory time limits, emphasizing that the time limit for availing ITC is a substantive statutory requirement.
Final Ruling
The AAR Tamil Nadu ruled as follows:
1. The applicant is eligible to avail ITC on GST paid for leasing, renting, or hiring motor vehicles to provide transportation for women employees, as mandated by the Tamil Nadu Shops and Establishments Act, 1947, subject to compliance with Section 16 of the CGST Act.
2. ITC is available only for transport provided to women employees arriving at or leaving the workplace between 8:00 PM and 6:00 AM.
3. The ITC is available from 28.05.2019 onwards, subject to statutory eligibility and time limits.
This ruling provides clarity on the scope of ITC eligibility for employers providing statutory transport facilities to women employees, reinforcing the requirement for strict compliance with both the substantive and procedural provisions of the GST law.
